Our client had been a 13-year-old boarder at Xavier College in Kew for only a few weeks when he was first abused by Father Noel Bradford, a Jesuit priest and dormitory supervisor who also coached sport.
Our client initially settled his compensation claim in 2011 for $150,000.
In June 2024 Rightside Legal successfully applied to the Supreme Court to have the original settlement deed overturned, because his original settlement was impacted by the then legal hurdles which existed.
Within a month of this decision, Xavier College settled for $1.15 million plus costs.
The Court set aside the original settlement because our client was not legally represented and he believed he had no possibility of suing the school formally.
The Court also found it ‘troubling’ that a priest at the school acted as both confidant to our client and as an agent of the school during the original 2011 settlement.
